Effective Date: This agreement governs your use of the Alhisab accounting software (the “Service”) offered by Alhisab and its parent company Retina Soft (collectively, “we,” “us” or “Alhisab”). By using our Service you agree to these Terms. If you do not agree, do not use or access the Service.
1. Plans and Subscriptions
- Premium Plans: We offer Starter, Advanced, and Pro plans. Each plan may be purchased on a recurring basis (monthly or annual) or as a one-time “Lifetime Plan.” The Lifetime Plan is a special option available for all Premium Plans and is purchased with a single fee.
- Lifetime Plan Definition: The term “Lifetime Plan” is expressly defined in these Terms as a fixed 50-year subscription starting from the purchase date. This 50-year duration is the parties’ agreed meaning of “lifetime” for this plan. Customers acknowledge that “lifetime” means 50 years and no more; any implication of perpetual or indefinite service beyond 50 years is expressly excluded. This explicit term is intended to remove ambiguity and align with best practices (many SaaS providers explicitly define “lifetime” in multi-decade terms).
- Lifetime Plan Term: The Lifetime Plan grants access to all features of the chosen Premium Plan for a 50-year period. After 50 years, service under the Lifetime Plan automatically terminates unless a new agreement is made. We explicitly treat the 50-year term as binding: customers agree that the Company’s commitment ends after 50 years. (By contrast, some providers cap “lifetime” at different terms – for example, one cloud storage service defined “lifetime” as 99 years or the company’s lifespan. Defining the term in years prevents disputes and ensures clarity.
- Other Subscription Terms: Monthly and annual subscriptions renew automatically until canceled. The Lifetime Plan is non-recurring. All plans require payment in advance of each term, according to our published pricing.
2. Refund and Payment Policy
We believe in complete transparency regarding our services.
4.1. Pre-Purchase Access
Before purchasing any subscription:
Users can explore Alhisab through free lifetime access to core features.
We provide detailed demo videos and tutorials on our official YouTube Channel to help users understand our offerings.
4.2. Payment Terms
All payments for premium plans and renewals must be made in advance through our authorized payment gateways.
Subscription fees are non-transferable.
4.3. Refund Policy
Once a user subscribes to or renews a premium plan:
No refund will be issued under any circumstances.
It is the user’s responsibility to review available demos and trial features before making a purchase decision.
In exceptional technical cases, Alhisab reserves the right (at its sole discretion) to review refund requests.
3. Account Responsibility
You agree to keep your account credentials confidential. Each subscriber may create individual user accounts as allowed by their plan. You are responsible for all activity under your account. Do not share login credentials. We reserve the right to suspend or terminate any account that violates these Terms, at our discretion and without liability.
4. Data Security and Backups
We use industry-standard measures to protect your data on our secure cloud servers. All data (including accounting records, documents, etc.) is encrypted in transit and at rest. We perform continuous backups of your data to prevent loss. In fact, many leading cloud services backup data “every minute”; we employ a similar strategy. In case of a system failure or other incident, we can restore from recent backups (our process allows restoring data from as recent as six hours prior to the event).
Note: while we aim for high availability and data protection, no system is fault‑proof. We disclaim liability for any data loss or service disruption beyond our reasonable control.
5. Data Ownership and Use
Your Data Ownership: You retain all ownership rights in the data you enter into Alhisab (“Customer Data”). We will not claim ownership of your information.
Confidentiality: We will treat your personal and business data as confidential. We do not sell, trade or otherwise provide your personal data (email, phone, company info, etc.) to other customers, competitors, or unrelated third parties. We collect only the information you provide to operate the Service.
Use for Research and Marketing: You acknowledge that we may use aggregate, anonymized data derived from your usage to improve our products and for marketing. For example, like other technology companies we may generate statistical reports or insights from user data without identifying individual users. We may also use customer data in accordance with our Privacy Policy to inform you about related Alhisab or Retina Soft offerings. However, we will not associate such analyses with you personally or sell your personal data.
Regulatory Compliance: We comply with applicable data protection laws (e.g. GDPR, CCPA). We have a separate Privacy Policy that explains how we collect, use, and protect personal data. By using the Service, you consent to our collection and processing of your information as described there.
7. Warranties Disclaimer
No Warranty: The Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, to the fullest extent allowed by law. This includes implied warranties of merchantability or fitness for a particular purpose. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure. You use the Service at your own risk. It is your responsibility to maintain independent backups of your data in addition to our backups.
8. Limitation of Liability
To the extent permitted by law, Alhisab and Retina Soft’s total liability for any claim related to the Service will be limited to the fees you paid for Alhisab in the six months preceding the claim. In no event will we be liable for special, indirect, incidental, or consequential damages (including loss of business, profits, data, or use) even if advised of the possibility of such damages. Some jurisdictions do not allow such exclusions, so they may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless Alhisab, Retina Soft, and their officers, affiliates, and employees against all claims, liabilities, damages, losses, and expenses (including legal fees) arising out of (i) your violation of these Terms, (ii) your misuse of the Service, or (iii) your violation of any rights of another.
10. Changes to the Service and Terms
We reserve the right to modify or discontinue the Service (or any feature) without notice. We may also change these Terms at any time. If we make material changes, we will post a notice on the website or notify you by email. Continued use of the Service after any such changes means you accept the new Terms.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Bangladesh (without regard to conflict of laws). If any provision is illegal or unenforceable under applicable law, that provision will be deemed modified to the minimum extent necessary, or severed, and the remainder will remain valid.
12. Miscellaneous
Assignment: We may assign or transfer our rights and obligations under these Terms to an affiliate or in connection with a sale. You may not assign your rights without our consent.
Entire Agreement: These Terms (together with our Privacy Policy and any order forms) constitute the entire agreement between you and Alhisab regarding the Service. They supersede all prior agreements.
